Your I-94 Record: The Most Important Document for Your U.S. Immigration Status

Posted by Karol Brown | Feb 11, 2025 | 0 Comments

If you're in the U.S. on a visa, there's one document you must check every single time you enter the country—your I-94 record. Many people mistakenly think their visa controls their stay, but that's not how U.S. immigration works.

Your visa lets you request entry to the U.S., but your I-94 determines how long you can stay.

Visa vs. I-94: What's the Difference?

✅ Your Visa = Entry Document

  • A visa is issued by a U.S. Embassy or Consulate outside the U.S.

  • It allows you to travel to a U.S. port of entry and request admission.

  • A valid visa does NOT guarantee entry—Customs and Border Protection (CBP) makes the final decision.

  • Once you enter, your visa no longer matters until your next trip abroad.

✅ Your I-94 = Status Document

Your I-94 record controls your immigration status once you are in the U.S. It tells you:

  • Your visa classification (H-1B, L-1, F-1, etc.).

  • How long you can stay in the U.S.

CBP issues a new I-94 every time you enter the U.S. You may also get an updated I-94 from the US Citizenship and Immigration Service if they approve an extension of stay or change of status.

You can check your I-94 online at the CBP website.

Why Your I-94 Matters More Than Your Visa

Even if your visa has expired, you can stay in the U.S. as long as your I-94 is valid (with some exceptions). However, if your I-94 expires, you could be out of status, leading to serious immigration consequences.

When Does Your I-94 Get Updated?

✅ Every time you enter the U.S. at a port of entry.
✅ When USCIS approves an extension or change of status (H-1B extensions, F-1 OPT, etc.). In this case, your new I-94 will be attached to your I-797 approval notice and overrides the CBP record until you leave the U.S.

Why You Should Check Your I-94 Every Time You Enter the U.S.

❌ CBP sometimes makes mistakes—wrong expiration dates or visa classifications can happen.
❌ Incorrect I-94 records can impact:

  • Driver's licenses

  • Work authorization (I-9 verification)

  • Bank accounts

  • Future immigration applications

How to Check Your I-94 Record

  1. Go to the official CBP I-94 website.

  2. Enter your passport details.

  3. Review your expiration date and visa classification.

  4. If something looks wrong, contact an immigration attorney immediately.

Key Takeaway

Your I-94 controls your lawful status in the U.S., not your visa. Check it after every entry to avoid issues that could impact your future immigration options.
